1. Acceptance of Terms

By accessing or using Crosstabs.com (the "Service"), you agree to be bound by these Terms of Service ("Terms") and our Privacy Policy. If you do not agree to these Terms, do not use the Service.

Changes to Terms: We may modify these Terms at any time. Continued use of the Service after changes constitutes acceptance. Check this page regularly for updates.

2. Description of Service

Crosstabs.com provides free, AI-powered statistical analysis of tabular data (CSV/Excel files). The Service includes:

• Automated crosstab analysis (chi-square tests, Cramer's V, Fisher's exact test)
• AI-generated insights via OpenAI's GPT-4 API
• Correlation analysis, machine learning clustering, data visualization
• Interactive AI chat for follow-up questions
• Shareable result URLs

3. Free Service - No Warranties

The Service is provided completely free of charge:

• ✅ No signup required
• ✅ No credit card required
• ✅ No trial period (free forever)
• ✅ Full GPT-4 access for all users
• ✅ No feature limitations
• ✅ Unlimited analyses

Because the Service is free, it is provided "AS-IS" with NO WARRANTIES of any kind. See Section 7 for full disclaimer.

4. User Responsibilities

4.1 Acceptable Use

You agree to use the Service only for lawful purposes. You MAY NOT:

• ❌ Upload illegal, harmful, or offensive content
• ❌ Upload data containing personally identifiable information (PII) without proper consent
• ❌ Upload viruses, malware, or malicious code
• ❌ Attempt to hack, disrupt, or overload the Service
• ❌ Use the Service to spam, harass, or harm others
• ❌ Scrape, crawl, or automate access beyond reasonable use
• ❌ Reverse-engineer or copy the Service
• ❌ Use results for medical, legal, or financial advice without independent verification

4.2 Data Responsibility

You are solely responsible for:

• The accuracy and legality of data you upload
• Obtaining necessary consents/permissions for data analysis
• Complying with applicable data protection laws (GDPR, CCPA, Privacy Act, etc.)
• Removing sensitive data (SSNs, credit cards, health records) before upload
• Verifying analysis results before making decisions

4.3 No Professional Advice

The Service provides informational content only. It is NOT:

• ❌ Professional statistical consulting
• ❌ Medical, legal, or financial advice
• ❌ Certified or peer-reviewed research
• ❌ A substitute for expert human judgment

Always consult qualified professionals (statisticians, researchers, domain experts) before making important decisions based on AI-generated results.

5. AI-Generated Content & OpenAI

5.1 Third-Party AI Provider

We use OpenAI's GPT-4 API to generate statistical insights. By using the Service:

• You acknowledge that insights are AI-generated and may contain errors
• You agree to OpenAI's Terms of Use and Usage Policies
• You understand we have NO CONTROL over OpenAI's API performance or availability
• You accept that OpenAI may process your data as described in their Privacy Policy

5.2 AI Limitations & Risks

AI-generated content can:

• ⚠️ Misinterpret data patterns or correlations
• ⚠️ Provide incorrect statistical interpretations
• ⚠️ Confuse causation with correlation
• ⚠️ Generate biased or misleading insights
• ⚠️ Fail to detect data quality issues
• ⚠️ Produce "hallucinations" (plausible-sounding but false information)

YOU MUST independently verify all AI-generated results. Do not rely solely on our Service for critical decisions.

5.3 Statistical Accuracy

While we compute statistical tests (chi-square, Cramer's V, p-values) using established Python libraries (scipy, pandas), the AI-generated interpretation of these statistics is not guaranteed to be correct. Always review raw statistics yourself or consult a statistician.

6. Intellectual Property

6.1 Our IP

The Service, including its design, code, algorithms, and branding, is owned by Crosstabs Pty Ltd and protected by Australian and international copyright, trademark, and intellectual property laws.

6.2 Your Data

You retain all rights to data you upload. By uploading data, you grant us a limited license to:

• Process your data to generate analysis results
• Temporarily store results (24 hours for cache, 12 months for shared links)
• Use aggregated, anonymized usage patterns to improve the Service

We do NOT claim ownership of your data and do NOT use it for training AI models (per OpenAI's Enterprise API terms).

6.3 Analysis Results

Analysis results (insights, charts, statistics) are generated by our Service and may be considered joint output. You may use, share, or publish results freely, but you MUST:

• Verify accuracy before publication
• Attribute results to "Crosstabs.com" if appropriate
• Not misrepresent results as human-generated or peer-reviewed

7. Disclaimers & Limitation of Liability

7.1 No Warranties

THE SERVICE IS PROVIDED "AS-IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO:

• ❌ Warranties of merchantability, fitness for a particular purpose, or non-infringement
• ❌ Warranties of accuracy, reliability, or completeness of AI-generated content
• ❌ Warranties that the Service will be uninterrupted, error-free, or secure
• ❌ Warranties that defects will be corrected

7.2 Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW:

• Crosstabs Pty Ltd, its directors, officers, employees, and affiliates SHALL NOT BE LIABLE for any indirect, incidental, special, consequential, or punitive damages arising from:
  • Use or inability to use the Service
  • Errors, inaccuracies, or omissions in AI-generated content
  • Decisions made based on analysis results
  • Data loss, corruption, or unauthorized access
  • Third-party services (OpenAI, Google, etc.)
  • Downtime, outages, or service interruptions
• Total liability for any claim shall not exceed AUD $100 (one hundred Australian dollars).

Some jurisdictions do not allow limitation of liability for consequential damages, so these limits may not apply to you.

7.3 Australian Consumer Law

Nothing in these Terms excludes, restricts, or modifies any consumer rights under the Australian Consumer Law (ACL) or other applicable consumer protection laws that cannot be excluded, restricted, or modified by agreement.

To the extent permitted by law, our liability for breach of any implied warranty or condition that cannot be excluded is limited, at our option, to:

• Re-supplying the Service; or
• Paying the cost of re-supplying the Service (which is $0, as the Service is free)

8. Indemnification

You agree to indemnify, defend, and hold harmless Crosstabs Pty Ltd from any claims, damages, losses, liabilities, costs, or expenses (including legal fees) arising from:

• Your use or misuse of the Service
• Your violation of these Terms
• Your violation of any laws or third-party rights
• Data you upload to the Service
• Decisions you make based on analysis results

9. Service Availability & Changes

We reserve the right to:

• Modify, suspend, or discontinue the Service at any time without notice
• Limit usage (e.g., file size, request frequency) to ensure fair access
• Block users who violate these Terms
• Change pricing (currently free; we will provide 30 days' notice if paid tiers are introduced)

We do NOT guarantee the Service will always be available or error-free. Use the Service at your own risk.

10. Third-Party Services

The Service integrates with third-party services, including:

• OpenAI: GPT-4 API for AI insights
• Google Analytics: Usage tracking
• Google AdSense: Advertising

These services have their own terms and privacy policies. We are NOT responsible for their performance, availability, or data handling practices.

11. Governing Law & Dispute Resolution

11.1 Governing Law

These Terms are governed by the laws of New South Wales, Australia, without regard to conflict of law principles.

11.2 Jurisdiction

Any disputes arising from these Terms or the Service shall be subject to the exclusive jurisdiction of the courts of New South Wales, Australia.

11.3 Informal Resolution

Before filing a legal claim, please contact us at legal@crosstabs.com to attempt informal resolution. Most disputes can be resolved quickly and amicably.

12. Termination

We may terminate or suspend your access to the Service immediately, without notice, for any reason, including:

• Violation of these Terms
• Abusive or harmful behavior
• Legal requirements

You may stop using the Service at any time. Upon termination:

• Your access to the Service will cease
• Cached results will be deleted per our Privacy Policy
• Provisions regarding disclaimers, liability, and indemnification will survive

13. General Provisions

13.1 Entire Agreement

These Terms, together with our Privacy Policy, constitute the entire agreement between you and Crosstabs Pty Ltd regarding the Service.

13.2 Severability

If any provision of these Terms is found invalid or unenforceable, the remaining provisions will remain in full force and effect.

13.3 No Waiver

Our failure to enforce any right or provision of these Terms does not constitute a waiver of that right or provision.

13.4 Assignment

You may not assign or transfer these Terms without our written consent. We may assign these Terms to any successor or affiliate.
